A trademark objection is raised by the Trademark Examiner under the Trademarks Act, 1999 when the application does not meet statutory requirements. Common reasons include similarity with existing trademarks, lack of distinctiveness, or incorrect classification. An objection does not mean rejection, but it requires a proper legal reply within the prescribed time to keep the application moving toward publication and registration.
WHY OBJECTIONS ARISE
Similarity with an existing registered or applied trademark.
The mark is considered too generic or descriptive to distinguish your goods.
Incorrect trademark class selection for the goods or services offered.
Use of terms that merely describe the product rather than identify a brand.
Incomplete or incorrect application details flagged during examination.
A CONTROLLED WORKING SYSTEM
The Trade Marks Registry issues the Examination Report.
A detailed objection reply is drafted and filed within 30 days.
A hearing before the Registrar takes place, if required.
Written arguments and supporting evidence are submitted.
Once accepted, the application is published in the Trade Marks Journal.
A registered trademark is valid for 10 years from the date of application. To continue enjoying exclusive rights, the trademark must be renewed every 10 years by filing Form TM-R with the Trade Marks Registry. Failure to renew on time may result in removal of the trademark from the register, weakening your ability to enforce it.
RENEWAL TIMELINE
The standard renewal window, filed ahead of the 10-year term ending.
Renewal remains possible with an applicable surcharge on the fee.
Filing before removal from the register avoids losing the mark entirely.
Restoration can still be pursued within one year of removal.
BEFORE YOU FILE
Copy of the examination report and full application details.
Invoices or promotional material relied upon in the reply.
Power of attorney authorising your representative.
Any applicable no-objection certificate or supporting undertaking.
Registration certificate and the trademark registration number.
Current details of the registered proprietor.
Power of attorney, if the renewal is filed through a representative.
Evidence of use, if seeking to strengthen the renewed registration.

COMMON QUESTIONS
A trademark objection is raised by the Trademark Examiner when an application does not meet statutory requirements. It is not a rejection, but a properly drafted reply must be filed within the prescribed time to keep the application alive.
A reply must generally be filed within 30 days of the objection being raised. Missing this deadline can result in the application being treated as abandoned.
An objection is raised by the Trademark Examiner during initial scrutiny, before publication. An opposition is a challenge filed by a third party after the mark is advertised in the Trade Marks Journal.
A trademark should be renewed within 6 months before its 10-year term expires. It can also be renewed within 6 months after expiry by paying a surcharge.
The Registrar may remove it from the register. A removed mark can, in limited circumstances, be restored within one year of expiry by filing Form TM-R along with the restoration fee.
Yes, within 6 months of expiry with a surcharge. Beyond that period, restoration is possible for up to a year from expiry, subject to the Registrar's discretion.
No. Many objections are resolved on the strength of the written reply alone. A hearing is scheduled only if the Examiner is not satisfied or specifically calls for one.
