    EXPERT DECISION GUIDE

Understand the work before you appoint a provider.

    01

Trademark pricing is calculated per mark and per class

A trademark application protects the filed mark for the goods or services described in the selected class. Adding a class changes both the official fee and the professional work. Filing a logo and a word mark separately can also create separate applications. A credible quotation must therefore state the number of marks, classes and applicant category assumed.

The official fee category depends on the applicant. Eligibility for the reduced category must be real and supported. Choosing a cheaper category without valid status can jeopardise the filing or require correction. RegisCorp confirms the owner and evidence before presenting the government component.

    • ₹2,500 professional fee per class
    • ₹4,500 eligible-category official e-filing fee per class
    • ₹9,000 other-applicant official e-filing fee per class
    • Separate scope for objections and oppositions
    • Applicant-approved specification before submission
    02

    Why ownership matters before filing

The trademark should ordinarily be filed in the name of the person or entity intended to own and control the brand. Filing personally when the operating company should own the asset, or filing through a company that has not yet received the rights, can create assignment, licensing, valuation and enforcement complications.

The decision should consider who created the mark, who uses it, who receives brand revenue, whether investors will expect the company to own intellectual property and whether an earlier user already has rights. Incorporation name availability is not a trademark clearance.

    • Identify the true brand owner
    • Document any transfer from founder to company
    • Keep use evidence in the owner’s name
    • Align domains, packaging, invoices and marketplace accounts
    03

    Search, classification and specification strategy

A search reduces avoidable risk but is not a guarantee. Similarity can involve appearance, sound, meaning, dominant elements and related goods or services. Searches should consider obvious spelling variants and commercially related classes rather than only an exact-name result.

Specifications should be commercially accurate. Copying an entire class heading can create unnecessary conflict and may not reflect genuine intended use. An excessively narrow list may fail to cover expansion. We map present use and credible near-term plans, then draft a specification the applicant can understand and defend.

    • Related-mark review
    • Correct Nice classification

How RegisCorp controls a trademark registration engagement

A reliable trademark registration engagement begins with a written scope rather than a payment link. We first identify the applicant, legal status, commercial objective, relevant jurisdiction, filing history and the records that are actually available. That intake allows the team to separate the standard filing path from corrections, legacy defaults, special approvals and work that belongs to another professional or authority. The result is a scope that a founder can understand before documents are signed or fees are committed.

Preparation and government processing are different stages. RegisCorp can control the quality of the information, drafting, review, classification, attachments, authorisations and submission record. It cannot promise an authority approval date, ignore a statutory requirement or guarantee that an officer will not ask for clarification. Our pages therefore distinguish the preparation target from the authority-controlled timeline and identify the assumptions behind every indicative estimate.

Every material instruction should leave an evidence trail. We preserve the approved scope, document checklist, final data sheet, filing set, acknowledgement and next-action note. Clients should retain their own copies of signed records, challans, acknowledgements and official communications. This creates continuity if a director, employee, consultant or authorised signatory changes later.

    • Written scope and separated fee components before execution
    • Document and data consistency review before submission
    • Client approval for names, descriptions, classifications and declarations
    • Acknowledgement and post-filing action map after submission
    • Clear identification of government-controlled outcomes and timelines
    05

What a high-quality application file should demonstrate

A filing is not strong merely because every upload field contains a document. Names, addresses, dates, ownership, business descriptions, financial information and signing authority must tell one consistent story across the application. A mismatch that appears minor to the applicant can trigger validation failure, clarification, resubmission or a later compliance problem. We therefore review the file as a connected legal and operational record, not as unrelated PDFs.

The application should also reflect the real business. Overbroad descriptions create ambiguity, while narrow or copied descriptions may omit the activities the business intends to conduct. Where classification, eligibility or threshold analysis is required, the conclusion should be recorded with the facts relied upon. The purpose is not to manufacture certainty; it is to make the selected route explainable and defensible.

Quality continues after submission. Contact details must remain accessible, OTP and authentication requests must be handled by the authorised person, and official notices must be reviewed promptly. A prepared applicant knows who will monitor the portal, where notices will be stored and who has authority to approve a response.

    06

    Timelines, approvals and responsible expectations

Timelines shown on this page are planning estimates, not statutory guarantees. They assume complete records, responsive signatories, functioning portals, successful identity or digital-signature checks and no unusual authority query. Weekends, public holidays, system downtime, name or classification objections, physical verification and third-party dependencies can extend the process. Urgent commercial commitments should never depend on an unqualified approval promise.

Where the law provides a response window, the official notice and applicable rule control the deadline. Clients should forward every notice immediately and should not wait for a reminder. A missed response can change the available remedy, increase cost or require a fresh filing. RegisCorp communicates the practical next step after reviewing the actual notice and current portal status.

After approval, the registration or filing must be integrated into operations. Certificates should be checked, business documents updated, invoices and contracts aligned, and recurring compliance placed on a calendar. A registration that is not maintained can become inactive, cancelled, non-compliant or commercially unreliable.

    07

How to compare professional quotations fairly

Compare like with like. A headline price may exclude government charges, stamp duty, digital signatures, search, drafting, tax, clarification responses, publication, hearing work or post-registration support. Ask every provider to identify the applicant category assumed, number of people or classes covered, included filings, excluded events and the point at which extra work becomes chargeable.

The lowest price is not automatically the lowest total cost. Incorrect ownership, an unsuitable structure, a missed class, inconsistent records or an unmanaged notice can require a second filing and can delay banking, contracting, fundraising or market entry. The commercial value lies in a correct route, an auditable file and accountable communication, not in concealing unavoidable components.

RegisCorp separates professional fees, statutory payments, third-party charges and applicable taxes. Where an amount depends on state, capital, applicant category, turnover, filing history or authority calculation, it is described as “at actuals” until the facts are confirmed.

    BUYER QUESTIONS

Answers before you approve the engagement.

What is the government fee for trademark registration?+

The current electronic fee is ₹4,500 per class for an eligible individual, startup or small enterprise and ₹9,000 per class for other applicants, subject to the official schedule and eligibility evidence.

Is ₹4,500 the total trademark cost?+

No. It is an official fee for eligible applicants. RegisCorp’s professional fee, taxes and any additional scope are separate.

Why is the fee charged per class?+

Trademark protection is organised by classes of goods and services. Every selected class creates a separate statutory fee and review scope.

Should I file a word mark or logo?+

A word mark can protect the textual brand independently of styling, while a logo filing protects the submitted representation. The right combination depends on the asset and budget.

Can a Private Limited Company use the ₹4,500 fee?+

Only if it validly qualifies under an eligible startup or small-enterprise category and can provide acceptable current evidence.

    Does a company-name approval protect the trademark?+

No. Company-name approval and trademark registration operate under different laws and registers.

Can registration be guaranteed after a clean search?+

No. Search results reduce uncertainty but do not bind the examiner, eliminate unregistered rights or prevent opposition.

Is a trademark objection reply included?+

Not unless expressly included in the written scope. Examination responses, hearings and oppositions are separate proceedings.

Can I claim use from an earlier date?+

Only where the claim is truthful and supported by appropriate evidence. A false use claim can damage the application and later enforcement.

Can I file before using the mark?+

An application may be filed on a proposed-to-be-used basis, subject to the facts and current law.

    How long does registration take?+

Timing depends on examination, objections, publication, opposition and registry processing. Filing acknowledgement is not the same as final registration.

What does the ™ symbol mean?+

It is commonly used to indicate a trademark claim. The ® symbol should be used only in accordance with registration status and applicable law.

Can one application cover every business activity?+

Only the classes and specification included in the application are examined. Multiple classes may be necessary for materially different goods or services.

    Do I need a separate international trademark?+

Indian registration is territorial. Protection abroad generally requires country-specific or international-route planning.

Can a trademark be transferred to another company?+

Trademark rights can be assigned subject to a valid transaction, documentation and applicable registry procedure.

    Professional fee: ₹2,500 per class

Each selected class creates a separate search, specification, filing and monitoring scope for the agreed mark.

    02

Eligible government fee: ₹4,500 per class

The reduced e-filing category applies only where the individual, startup or small-enterprise applicant validly qualifies and holds acceptable evidence.

Examination objections, hearings, oppositions, assignments and renewals are distinct proceedings unless expressly included in writing.
